Trump Supports Sessions' Marijuana Decision, Breaking His Campaign Promise

Trump Supports Sessions' Marijuana Decision, Breaking His Campaign Promiseā€

In this new memo, Sessions permits US attorneys to seriously enforce federal law - rescinding the Cole memo - in states where marijuana use is both illegal and legal. "I'm a states person".

"I think it's up to the states", Trump told NBC's Denver affiliate in 2016.

Yet officials suggested to reporters Thursday that businesses and growers in legalized states have gotten too comfortable and that the primacy of state law means very little in Washington.

But before Thursday, U.S. Attorneys in states like Nevada had been operating under guidelines from the President Obama era.

The Oregon State Police a year ago released an analysis of the state's compliance with the Cole memo in light of legalization.

Some advocates and political leaders are warning the new Department of Justice guidance on marijuana prosecutions could have dire consequences for chronically ill patients for whom marijuana products provide a measure of relief.

"In deciding which marijuana activities to prosecute under these laws with the department's finite resources, prosecutors should follow the well-established principles that govern all federal prosecutions", Sessions said in a memo to all federal prosecutors.

"[He] did not tell any U.S. Attorneys to go after any businesses", Sillitoe said.

The decision, which rescinds previous marijuana prosecution policies, comes just days after the State of California began legal recreation sales of marijuana on January 1. They also declined to specify what message the attorney general is sending to the pot industry, which is expanding in states with their own more lenient laws. The tone set by Sessions today puts people in those states on notice as well.

Obama-era guidance gave low priority to prosecutions of medical marijuana dispensing under state law.

OR collected more than $108 million in taxes from marijuana sales between January 2016 and August.

So either Trump lied about protecting marijuana laws and actually wants to crackdown or he just doesn't care about the issue and is just letting Sessions do whatever he wants. Before Sessions' announcement, experts predicted the USA market might reach $50 billion by 2026.

"Going against the majority of Americans - including a majority of Republican voters - who want the federal government to stay out of the way is perhaps one of the stupidest decisions the Attorney General has made", Blumenauer said in a statement.

But it's far from clear that his action will have much of an impact on the nation's steadily expanding marijuana industry or its millions of users. The Rohrabacher-Farr Amendment now protects state-compliant medical marijuana patients, caregivers and businesses from federal persecution, but it is only in effect until January 19; after that it will be reconsidered by a House-Senate conference committee. "In fact, they don't even need to convict, they just need to start sending threatening letters to landlords". In November, Sessions named him the interim USA attorney.

"I am prepared to take all steps necessary, including holding DOJ nominees, until the Attorney General lives up to the commitment he made to me prior to his confirmation", Gardner tweeted Thursday.

Former Republican Maryland state delegate Don Murphy, who now works in conservative outreach for the Marijuana Policy Project, said the AG's move, presumably sanctioned by Trump, is odd considering the populist wave in favor of decriminalizing marijuana across the country-not only in blue states, but places like Arkansas, the first Bible Belt state to legalize medical marijuana, and with 53 percent of the vote.

"There needs to be a difference of view between medical marijuana and recreational use of marijuana", Governor Asa Hutchinson said.
